Bivens action
Name for type of action (derived from Bivens v. Six Unknown Named Defendants, 403 U.S. 388, 91 S.Ct. 1999) for damages to vindicate constitutional right when federal government official has violated such right. Action is available if no equally effective remedy is available, no explicit congressional declaration precludes recovery, and no "special factors counsel hesitation." Rauschenberg v.
